ADA/Section 504
In accordance with the requirements of Title II of the Americans with Disabilities Act of 1990 (“ADA”) and Section 504 of the Rehabilitation Act (“Section 504”), the Town of Gypsum (“Town”) will not discriminate against qualified individuals with disabilities based on disability in its services, programs, or activities.
The Town does not discriminate based on disability in its hiring or employment practices and complies with all regulations set forth by the U.S. Equal Employment Opportunity Commission under Title I of the ADA.
The Town will generally, upon request, provide appropriate aids and services leading to effective communication for qualified persons with disabilities so they can participate equally in the Town’s meetings, programs, services, and activities, including qualified sign language interpreters, documents in alternative formats, and other ways of making information and communications accessible to people who have speech, hearing, or vision impairments.
The Town will make all reasonable modifications to policies and programs to ensure that people with disabilities have an equal opportunity to enjoy all Town programs, services, and activities.
The Town will not place a surcharge on a particular individual with a disability or any group of individuals with disabilities to cover the cost of providing auxiliary aids/services or reasonable modifications of policy, such as retrieving items from locations that are open to the public but are not accessible to persons who use wheelchairs.
The Town will take all required action to provide access to its buildings and facilities for individuals with disabilities. The Town’s sidewalks built or altered after 1992 will comply with ADA. Town-owned sidewalks constructed before 1992 will be updated and brought into ADA compliance as Town budget and time allocations reasonably allow. All Town-owned sidewalks are part of the Gypsum Sidewalk Maintenance & Repair Program, which inventories, prioritizes, and schedules ongoing public facilities maintenance needs.
The ADA does not require the Town to take any action that would fundamentally alter the nature of its programs or services or impose an undue financial or administrative burden.
Requesting an Accommodation
Anyone who requires an auxiliary aid or service for effective communication or a modification of policies or procedures to participate in a Town meeting, program, service, or activity should contact the Town’s ADA Coordinator or the department hosting the meeting, program, service, or activity as soon as possible but no later than 72 hours before the scheduled event through any of the following means:
